Acceptable Use Policy

1. What this covers

This policy sets the rules for using any Atelis service. It forms part of your agreement with us, alongside our Terms and Conditions.

It applies to you and to anyone you let use your service — staff, family, guests, customers, or anyone who gets on because you left it open. If they break these rules, you're the one we deal with.

2. The basics

Don't use an Atelis service to do anything illegal, and don't use it to interfere with anyone else's use of the internet or of our network.

That's the whole policy. The rest is detail.

3. What you must not do

Break the law. Store, send or publish anything that's unlawful, or that would expose you or us to civil or criminal liability. This includes material that defames, harasses, threatens or vilifies someone.

Infringe copyright. Don't copy, share or make available material you don't have the right to. If we get a credible infringement notice about content we host, we may remove it and we'll tell you why.

Attack things. No unauthorised access to any system or network, no port scanning or vulnerability probing without the owner's permission, no denial-of-service traffic, no distributing malware, no credential stuffing, no defeating anyone's security controls.

Forge or spoof. No forged email headers or sender addresses, no spoofed source IP addresses, no impersonating another person or another network.

Abuse our network. Don't announce IP space or AS paths you aren't authorised to announce. Don't run services that damage our routing, our IP reputation or our upstream relationships. Don't resell or sub-allocate IP space we've assigned you without asking us first.

Send spam. See section 4.

Help someone else do any of the above.

4. Spam and email

You must comply with the Spam Act 2003 and the Spam Regulations 2021. Specifically:

  • Don't send unsolicited commercial email or SMS from our network, and don't use our network to support a spam operation run elsewhere.
  • Don't run an open mail relay or open proxy.
  • Don't harvest email addresses, or use software that does.
  • Secure anything of yours that's connected to our network. A compromised device sending spam is still your responsibility, whether or not you knew about it.

We scan IP ranges we've assigned you for open relays and misconfigured mail and proxy servers. If we find one, we'll contact you and give you a chance to fix it before we act, unless the volume of abuse means we have to act immediately.

If you're being spammed by an Atelis customer, report it to abuse@atelis.com.au. You can also report spam to the ACMA at acma.gov.au.

5. Security and your account

Keep your account credentials, portal logins and equipment passwords secure. You're responsible for what happens on your service and for charges run up by anyone using it, including someone who got hold of your password.

Tell us straight away at abuse@atelis.com.au if you think your service or account has been compromised.

We may block ports, filter traffic or rate-limit a service where it's necessary to protect the network or other customers — for example, blocking a port being used in an active attack. We'll tell you when we do and why.

6. Fair use of capacity

Use your service within the limits of your plan. If your usage is degrading the service for other customers or threatening the stability of our network, we'll contact you to sort it out. If we can't, we may shape, limit or suspend the service.

We won't shape or limit you for using the capacity you've paid for. This clause is about abuse, not about heavy legitimate use.

7. Content and children

You decide what you access. Deciding what the people on your connection can access — including children — is also your job, and there are filtering tools available if you want them.

Some things are not negotiable. Do not use an Atelis service to access, store or distribute child sexual abuse material, or to make inappropriate contact with a child. If we have reason to believe you have, we will suspend the service immediately and refer the matter to the Australian Federal Police. We won't warn you first.

The eSafety Commissioner can require us to remove content or block access to material under the Online Safety Act 2021, and we're required to comply. We may also be directed to block abhorrent violent material. We'll do so without notice to you where the law requires it.

8. Law enforcement and regulators

We cooperate with law enforcement, security agencies and regulators where the law requires it, including interception and disclosure obligations under the Telecommunications (Interception and Access) Act 1979. Our Privacy Policy explains what we're required to disclose and to whom.

We may suspend or restrict your service if there are reasonable grounds to suspect it's being used for illegal conduct, or if it's the subject of a law enforcement investigation.

9. If you breach this policy

Normally we'll contact you, explain the problem, and give you a reasonable period to fix it. What's reasonable depends on the damage being done — an open relay pumping out spam gets hours, not weeks.

For serious breaches we may suspend immediately without notice. That includes active attacks, child abuse material, and anything putting the network or another person at risk.

If your service is suspended and you haven't fixed the cause within seven days, we may terminate it. Clause 12 of our Terms and Conditions covers what you owe if that happens.

We're not liable for losses you suffer because your service was suspended or terminated for breaching this policy.

10. Reporting abuse

Report network abuse, spam or security incidents involving Atelis IP space to abuse@atelis.com.au. We monitor that address and respond.

11. Changes

We may update this policy. We'll email you and publish the change at www.atelis.com.au. Continuing to use the service after that means you accept it. If a change materially disadvantages you, clause 17 of our Terms and Conditions gives you the right to cancel without an early termination charge.
